“ORDER IMPOWERING CALEB KINGSBURY, GUARDIAN, TO JOIN ‘WITH
EPHRAIM WARE IN THE PARTITION OF AN ESTATE.

A Petition of Caleb Kingsbury of Needham Setting forth That  about eight years since he was appointed by the then Judge of Probate for the County of Suffolk Guardian to two Non-compos Persons of said Town, John Gill and Israel Gill; who held a small real Estate in common and undivided. That said John is since dead and Administration of his Estate was granted to the Petitioner. That there being no personal Estate for the payment of the deceased’s debts, liberty was granted by the Superior Court for the Sale of the said John’s real Estate being undivided as aforesaid, and the Petitioner sold the same to Ephraim Ware of Needham, & has accounted for the Proceeds And praying That he may be impowered in behalf of the surviving Non-compos to join with the said Ephraim Ware in making Partition of the said Real Estate.

Read and Ordered

That the Prayer of this Petition be granted. And the Petitioner is hereby impowered to join with the within named Ephraim Ware in the partition of the Real Estate within mentioned, as fully as the said Israel the surviving Non-compos person might do if He were of a sound mind and not under Guardians as therein mentioned. [Passed April 16.”
